Where to buy and use
​
Eva's gift cards can currently be purchased in store and redeemed at our 454 Bloor Street W, Square One and Port Credit locations.

The cards must be treated like cash and kept safely – we cannot replace lost or stolen cards. See below Terms and Conditions for further information.

1. Activating and redeeming your gift card
1.1 The Eva’s Original gift card (Card) is issued by Original Chimneys Inc, 454 Bloor Street West, Toronto (The Company)
1.2 The credit on the Card can be redeemed partly or in full for a purchase at all participating locations of The Company
1.3 The current balance on the Card will be displayed on your receipt upon purchase and can be checked in all participating locations
1.4 The Card balance will not be refunded or gain interest

2. Card Validity
2.1 The Card can only be used in the country of issue
2.2 The Card does not expire
2.3 The Company reserves the right to decline payment with a Card in individual cases if payment is not possible due to technical problems

3. Refunds
3.1 If you are entitled to a refund, the purchase price will only be refunded by loading the amount back onto the Card
3.2 You are obliged to retain the Card for this purpose. If you no longer have the gift card then a refund will not be issued
3.3 If a Card has been used in conjunction with another form of payment for this purchase, then the refund will be made with priority given to the form of payment which the customer chose in addition to the gift card. Any other remaining balance will be loaded back onto the Card
3.4 There is no right to exchange for the customer Card itself except in cases of mandatory legal provisions
4. Exclusion of Liability
4.1 The Card must treated as cash
4.2 It can be used by any person who has the Card in their possession. The Company is not obliged to verify the identity of the card holder.
4.3 There is no option to inactivate a Card
4.4 The Company and its participating stores will not accept liability for the Card’s balance, especially if cards are lost, unreadable, stolen or misused except where The Company or one of the participating stores or an employee is accused of intentional or grossly negligent actions
5. Applicable Law
5.1 Canadian law applies

6. Severability Clause
6.1 Should one or more provisions of these terms and conditions be or become invalid, the validity of the remaining provisions will not be affected. The invalid provision shall be replaced by a provision that legally and actually comes as close to the economic intention of the invalid provision
6.2 The Company reserves the right to amend these terms and conditions at any time
